TERMS AND CONDITIONS OF SALE

  1. General Provisions

These Terms and Conditions of Sale (the "Agreement") govern the purchase of marshmallow products ("Products") from The Marshmallow Place ("Seller") by the purchaser ("Buyer").

  1. Orders and Payment

a. Orders. Buyer may place orders for Products by email or online. Each order must specify the type and quantity of Products requested, the desired delivery date, and the delivery address.

b. Payment. Payment for Products must be made in full at the time of order placement. Payment may be made by credit card, PayPal, or other payment methods offered by the Seller.

  1. Shipping and Delivery

a. Shipping. The Seller will ship the Products to the delivery address specified by the Buyer in the order. The Seller will use reasonable efforts to ship the Products on the date requested by the Buyer, but cannot guarantee delivery on any particular date.

b. Delivery. Delivery of the Products will be completed upon the Seller's delivery of the Products to the carrier for shipment to the Buyer. Risk of loss or damage to the Products will pass to the Buyer upon delivery to the carrier.

  1. Product Returns and Refunds

a. Returns. The Seller does not accept returns of Products, except in the case of defective Products. If Buyer receives defective Products, the Buyer must notify the Seller within 1 day of delivery and provide proof of the defect. The Seller will replace the defective Products or refund the purchase price, at the Seller's option.

b. Refunds. Refunds will be made to the original payment method and may take 7-10 business days to process.

  1. Limitation of Liability

To the maximum extent permitted by law, the Seller's liability for any claims arising out of or related to this Agreement or the Products shall be limited to the purchase price of the Products. In no event shall the Seller be liable for any consequential, incidental, or indirect damages.

  1. Governing Law and Dispute Resolution

This Agreement shall be governed by and construed in accordance with the laws of Alberta, Canada without regard to conflicts of law principles.

  1. Entire Agreement

This Agreement constitutes the entire agreement between the parties with respect to the purchase of the Products and supersedes all prior or contemporaneous communications and proposals, whether oral or written. No modification of this Agreement shall be effective unless in writing and signed by both parties.

By placing an order, Buyer acknowledges and accepts these Terms and Conditions of Sale.
